A few honest questions about your estate plan:
- Is the house actually titled in the trust — including after that refinance?
- Do your beneficiary forms say the same thing your trust does?
- Did your 401(k) rollover and the accounts you've opened since ever make it into the plan?
- Could your family find all your accounts, passwords, and the people to call?
- Does anyone besides you know where any of this is written down?
If any of those made you pause, your estate plan still has homework. That's normal. It's also fixable.
An unfinished plan costs you twice.
You paid to avoid probate. An unfunded trust sends your family there anyway: court costs and fees that can consume 3 to 5% of the estate, a year or more of proceedings, and your affairs on the public record. Attorneys call it the most common way estate plans fail. The fix isn't more documents. It's follow-through.
